1. Acceptance of Terms

By accessing or using XPoster ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

XPoster is a Chrome browser extension that provides AI-powered reply suggestions for X.com (formerly Twitter). The Service includes:

  • AI-generated reply suggestions based on tweet context
  • A credit-based system for accessing AI features
  • Integration with X.com platform
  • Cross-device synchronization of credits and settings

3. User Accounts

3.1 Account Creation

To use XPoster, you may need to create an account. Accounts are created using anonymous authentication, which means:

  • No personal information is required to create an account
  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activities that occur under your account

3.2 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4. Credit System and Payments

4.1 Credits

XPoster uses a credit-based system:

  • Credits are required to use AI-powered features
  • Credits can be purchased through cryptocurrency payments (USDC, USDT)
  • Credits are non-refundable except as required by law
  • Credit prices and packages may change at any time

4.2 Payment Terms

By purchasing credits, you agree to:

  • Provide accurate payment information
  • Pay all charges incurred by your account
  • Pay all applicable taxes
  • Accept that all payments are final unless otherwise stated

4.3 Refunds

Refunds are provided at our sole discretion. Unused credits are generally non-refundable. If you believe you are entitled to a refund, please contact us with your request and supporting documentation.

5. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To collect or track the personal information of others
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose
  • To interfere with or circumvent the security features of the Service

The Service and its original content, features, and functionality are owned by XPoster and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

7. User-Generated Content

The Service may allow you to generate content using AI. You retain ownership of any content you create using the Service. However, by using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving the Service.

You are solely responsible for the content you generate and use. You agree not to use the Service to generate content that is illegal, harmful, or violates any third-party rights.

8. Service Availability

We strive to provide continuous availability of the Service, but we do not guarantee:

  • Uninterrupted or error-free operation
  • That the Service will be available at all times
  • That defects or errors will be corrected
  • That the Service is free of viruses or other harmful components

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9. Limitation of Liability

To the fullest extent permitted by law, XPoster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

10. Indemnification

You agree to defend, indemnify, and hold harmless XPoster and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cambodia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cambodia.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

These Terms constitute the entire agreement between you and XPoster regarding the use of the Service and supersede all prior agreements and understandings.
